Terms and Conditions of Use

1.1 You must be 18 years or older and a resident of South Africa to use the App and enter any draw.

1.2 You must provide accurate and complete personal information as part of our identity verification process.

2.1 All draws on the App are free to enter.

2.2 No purchase or payment of any kind is required to participate.

3.1 The closing date for each Draw depends on the draw type.

• Daily - closes daily (Monday - Sunday) at 23:59 (GMT+2)
• Weekly - closes at 23:59 (GMT+2) every Sunday
• Monthly - closes at 23:59 (GMT+2) on the last day of every month

3.2 Once a draw is closed, no more entries will be allowed.

4.1 Each valid entry constitutes one chance to win in the relevant Draw.

4.2 Winners are selected at random from all entries received for a specific draw.

4.2 Winners will be contacted by Fortune Surge within seventy-two (72) hours of the draw via the email address and/or mobile number provided by the Player.

5.1 As required by the Financial Intelligence Centre Act (FICA), users must complete a KYC process before claiming any prize.

5.2 You agree to provide necessary documentation (e.g. SA ID, proof of address) when requested.

5.3 Failure to complete KYC verification may result in disqualification or forfeiture of winnings.

6.1 You are responsible for ensuring that all information provided remains accurate, complete and up to date.

6.2 Fortune Surge shall not be liable for any failure to contact a Player that arises from inaccurate or outdated contact information.

7.1 Cash prizes will be paid into a South African bank account.

7.2 Cash prizes are subject to South African Revenue Service (SARS) regulations.

7.3 Prizes won may be considered gross income under the Income Tax Act and may be taxable.

7.4 It is the responsibility of the winner to declare winnings and pay any applicable taxes.

7.5 Fortune Surge may withhold a portion of winnings if required by law.

7.6 Prizes are non-transferable and non-negotiable.

8.1 By using this App, you consent to the collection, storage, and processing of your personal information as described in our Privacy Policy.

8.2 Information may be shared with third-party service providers for the purposes of:

• KYC and identity verification
• Prize distribution
• Fraud prevention and legal compliance

8.3 We are committed to complying with the Protection of Personal Information Act (POPIA).

9.1 You may not:

• Use bots, scripts, or automation to participate in draws
• Open multiple accounts
• Provide false or misleading information

9.2 We reserve the right to suspend or terminate your access if you violate these terms or engage in suspicious activity.

10.1 App store and platform reviewers (including staff and contractors of Apple, Google Play, and similar platforms) cannot claim prizes while reviewing Fortune Surge as part of their job.

10.2 This restriction applies only during the period of the professional review or assessment.

10.3 Fortune Surge may verify a claimant's employment status and withhold or cancel a prize if this rule applies.

10.4 People using the platform in a personal capacity, and not as part of their professional duties, remain eligible to win prizes.

11.1 Winners may be publicly announced via the App and/or social media platforms.

11.2 By entering a draw, you consent to your name and/or photo being used for promotional purposes, unless you opt out in writing.

12.1 Winners must claim their prize within 6 months of winning.

12.2 If they cannot be contacted, do not respond, or fail to meet claim requirements within this period, the prize is forfeited.

12.3 Once forfeited, the player loses all rights to the prize.

12.4 No late claims will be accepted after the 6-month period.

13.1 Fortune Surge is not responsible for:

• Technical failures or downtime
• Incomplete or incorrect entries
• Loss or theft of prizes once transferred to the winner

13.2 The App is provided "as is" without warranties of any kind.

14.1 We reserve the right to modify, suspend or discontinue the App or any draw at any time without notice.

14.2 You may delete your account at any time; however, account deletion forfeits any pending draws or unclaimed prizes.
